This Regulatory Update was amended on 23 September to correct the deadline date of authorisation for storage and use and to add an annex giving a list of substances to which this Regulatory Update applies
Background
Regulatory Update 02/2008 provided information about new procedures for re-submission of applications and decision making on review substances not included on Annex I of Directive 91/414/EEC.
Revised timescale for voluntarily withdrawn substances
Authorisations for substances which were not included in Annex I following their voluntary withdrawal from the review by notifiers were to be withdrawn by 31 December 2010, with use allowed until 31 December 2011.
A substantial number of voluntarily withdrawn active substances were resubmitted for evaluation under the accelerated procedure laid down in Commission Regulation (EC) No 33/2008. It has become clear, however, that it will not be possible to evaluate and reach decisions on these substances within the original timescale. The deadlines for authorisations of these substances have therefore been extended by Commission Regulation (EU) No 741/2010 and Commission Decision 2010/455/EU by one year as follows:
- authorisations for sale and supply are to be withdrawn from 31 December 2011;
- authorisations for storage and use are to be withdrawn from 31 December 2012.
Please note that these extensions apply only to substances which were voluntarily withdrawn from the review and resubmitted under the accelerated procedure; they are listed in the Annex below.
