Procedures for the Parallel Import of Pesticide Products for the Applicant's Own Use

Background

An 'Own-Use' parallel import approval gives permission for farmers, growers, contract sprayers or other users of pesticides to store and use pesticides purchased and imported from outside the UK. The product to be imported must be identical to a product already approved for placing on the market and use in the UK (the master product). Identicality is verified by PSD during the evaluation of the application for approval. Approval is restricted to the storage and use of the imported product. Sale, supply or advertisement of the product is not permitted. Advice and instructions on how to apply for an own use parallel import approval were issued on 31 January 2003 in All Approvals Holders letter 02/2003.

Period of Approval

All Approvals Holder Letter 13/2003 dated 17 June 2003 explained revised arrangements for the approval of parallel imports. It explained that each approval for an Own-Use parallel import would last for a period of 2 years.

PSD has recently decided that the safeguards in place for the approval of own-use parallel imports are sufficient to allow for this 2 year limit on the period of approvals to be removed. The approval and revocation procedures concerning the period of an own-use product will therefore now be the same as those that apply to commercial parallel imports. Essentially this means that an approval will be granted for a maximum of 10 years provided there are no outstanding safety or data issues with the master product. The expiry dates for all extant ‘own use’ approvals issued since 2003 will be revised in line with the master approval from the date they were originally authorised.
