Background
Under Council Directive 91/414/EEC, chloropicrin was submitted for review but was voluntarily withdrawn under a procedure developed by the European Commission to give an opportunity for gaps in the data package to be filled. Commission Decision 2008/934/EC (as amended by Commission Decision 2010/455/EU) allowed a long withdrawal period (31 December 2011 for sale and supply and 31 December 2012 for storage and use) to allow the notifier time to resubmit another application with the additional data.
However following evaluation of the resubmitted dossier, the Commission proposed non-approval of chloropicrin.The Standing Committee on the Food Chain and Animal Health could not reach an opinion on that proposal, which was consequently referred to the Appeal Committee. The Committee met on 5 December 2011 and, although agreeing to the non-approval proposal, allowed a further 6 month withdrawal period for this substance.
Withdrawal and Expiry Dates
Commission Implementing Regulation (EU) No 1381/2011, concerning the non–approval of the active substance chloropicrin, was published on 23 December 2011. Chloropicrin products will be withdrawn from the market for sale and supply on 23 June 2012. Storage and use may continue until 23 June 2013.
