Withdrawal of Tevday (M13783)

The parallel trade permit for the sale, supply, use and advertisement of Tevday (MAPP No 13783) has been withdrawn with immediate effect.

Any remaining stocks of this product should not be sold, distributed, advertised or used or by any persons and should be returned together with any unused product to the permit holder as soon as possible and no later than 30th September 2012. The permit holder for Tevday in the UK is AgChem Access Ltd of Pure House, 64-66 Westwick Street, Norwich, Norfolk, NR2 4SZ.

Pending return of such product to Agchem Access Ltd, you may continue to store this product until 30th September 2012.

Background

Following an investigation into Tevday by the HSE, evidence has been obtained that the product is not being marketed in the permitted container and is not identical with the UK reference product, both of which are requirements for placing on the market.

Tevday is subject to a parallel trade permit. A parallel permit allows the importation of a product (the source product) from one EU Member State into another provided it is identical to a product (the reference product) already on the market in the Member State of import. In the case of Tevday the parallel permit is based on the importation and repackaging of a Du Pont product - Vydate 10G (PCS 91518) marketed in Ireland on the basis of its identicality with the UK reference product Vydate 10G (MAPP No. 02322).

The parallel permit for Tevday allows it to be supplied in either:

  1. Polyethylene lined paper bag containing 10 kg of product; or
  2. Polyethylene lined aluminium foil and paper bag containing 10 kg of product.

The on-going HSE investigation found Tevday marketed in string/twine tied plastic bags inside 15 Litre plastic tubs. Because the product being marketed by Agchem Access Ltd as Tevday does not comply with the conditions of the parallel permit issued for it on 21st January 2008, and amended on 3rd April 2008, HSE are taking steps to immediately withdraw the permit, and to alert end users ,and others who may have stocks of Tevday, to return it to AgChem Access Ltd as soon as possible for disposal and/or destruction. The product as marketed has not been subject to an evaluation to establish if it is safe to use and may present an additional hazard, particularly to users.

Authorisation for the sale, distribution and use of the product by anyone is withdrawn from 31st July 2012.

Approval is given until 30th September 2012 for storage pending disposal and/or destruction.
