Notification of additional active substances prohibited under the Long Term Arrangements for Extension of Use (non edible crops).

Introduction

Further to Regulatory Update 1/2008, this update advises of additional active substances excluded from the Long Term Arrangements for Extension of Use LTAEU .

Information for Growers and the Crop Protection Industry

A new restriction has now been added to the LTAEU prohibiting the use of any product containing the active substances listed in Appendix 1. Any products containing these substances (either singly or in mixture with other substances excluded under the LTAEU) must not be used under the LTAEU from the 1 September 2012. In many cases these former LTAEU uses now have replacement Extensions of Authorisation for minor use (EAMU’s) and the active substances that have EAMU’s or for which replacement EAMU’s have been requested are highlighted in Appendix 1. The uses requested will be considered and authorised or refused before 1 September 2012. Copies of the EAMU notices are available for viewing on the Extension of Authorisation for Minor Use Database.

Not all of the active substances listed in Appendix 1 have replacement EAMU’s, as either they were not requested or the use does not meet the regulatory requirements. Authorisation can be requested via the normal application procedures for a use that was previously allowed under LTAEU in respect of a product containing excluded active substances. Applications of this type will be considered using the normal extension of use application procedures and will be evaluated on a case by case basis. These applications will be subject to the standard requirements and the standard application fee. It is recommended that applicants contact applicant enquiries for advice at the address detailed below before submitting an application.

Any product containing an active substance on the excluded active substance list given in LTAEU arrangements plus an active substance not listed can continue to be used until all the component active substances appear on the list (sometime over the next 4 years). It is the user’s responsibility to check this list before using such products. The list contains many active substances which are not authorised for use in UK plant protection products (PPP’s) and active substances that were never considered under UK national rules (i.e. COPR ). These have been included for completeness.

The remaining requests will be considered on an ad-hoc basis as the component active substances are approved under Regulation (EC) 1107/2009 and the plant protection products containing them are re-registered. Additions to the list of replacement EAMU’s for active substances not yet excluded from LTAEU can be requested by submitting to us, at the address below, details of the plant protection product (name and MAPP number), LTAEU crop(s) required and the on-label crop the use is to be based on. The prohibited active substance list as detailed in the LTAEU will be expanded as these EAMU’s are issued until all UK products have been re-registered. Thus the number of plant protection products available for use under the LTAEU will decrease until the Arrangements are no longer valid. At this point they will be withdrawn.

Please note that the restriction of use of these active substances/products only relates to use under the LTAEU and does not impact on any other uses or authorisations. If these active substances/plant protection products currently hold authorisation (on-label or extension of use) for use on LTAEU crops, these uses will remain authorised.
