Potential and Agreed Changes to Maximum Residue Levels (MRLs)

1. Proposals under Discussion or Pending Publication
Since September 2008 all statutory MRLs have been set on an EC-wide basis under Regulation 396/2005. For further information on this Regulation please follow this link. Proposals to set, modify or delete MRLs in Regulation 396/2005 are now under consideration. These proposals are based on EFSA Opinions and are subject to votes in the Standing Committee. Raised levels need only one vote, whereas lowered levels require two votes. In the latter case, proposals are notified to the World Trade Organisation (WTO) following the first indicative vote to allow third countries to raise any points of difficulty. Once all concerns have been addressed a second formal vote is taken by the Committee, after which the proposal is adopted provided the necessary majority of member states is secured and following scrutiny by the European Parliament and Council.
We welcome any comments on proposals. If possible, please submit these well in advance of discussions in the Standing Committee (to russell.wedgbury@hse.gsi.gov.uk) .
The next Standing Committee meeting is scheduled for 14 & 15 October 2010.
Proposals which are adopted are published as EC Regulations. At present the time between agreement at the Standing Committee and publication in the Official Journal is around 5 months. From experience to date, these Regulations come into force on publication (for raised levels) or around 6 months later (if they include any lowered levels).
Exporters may be interested in notifications published on the WTO web site detailing proposed changes to MRLs in non-EU countries.

Last discussed at the October 2009 meeting. Awaiting further proposals from the Commission. MRL will be reduced to LOD unless substantive levels are needed based on Codex levels or import tolerances. 2. Published Regulations
The following proposals have been agreed and became national law from the applicable date.
When new MRLs are agreed we look at all product approvals containing these active substances. Any approvals that would result in residues in excess of the new MRLs will be revoked. This will ensure growers and suppliers do not put produce containing residues in excess of the MRL into circulation. Approval holders may apply to change the conditions of use to ensure that residues do not exceed the MRL.
